EXPERIENCE
Tueth, Keeney, Cooper, Mohan & Jackstadt, P.C. attorneys represent businesses, institutions of
higher learning, and individuals with respect to immigration-related matters, including obtaining visitor visas, temporary
and permanent work visas, consular processing of visas, obtaining citizenship, advising employers on employment sanctions
issues, and defending employers faced with INS I-9 audits and investigations.
We also prepare a strategy for obtaining the appropriate visas for clients and their family members, and have assisted
clients in obtaining visas for:
- Business visitors (B), including B visas in lieu of H visas;
- Treaty Traders or Treaty Investors (E);
- Student Visas (F, J, M)
- Specialty occupations (H-1B1);
- Temporary workers (H-2);
- Trainees (H-3)
- Exchange visitors (J);
- Fiancés (K);
- Intra-company transferees (L);
- Religious workers (R);
- Professionals pursuant to the North American Free Trade Agreement ("NAFTA") (TN); and
- Exceptional Ability (O).
Employers and colleges alike must be aware of recruiting and hiring issues involving individuals on
student visas (F, M, J). Accordingly, we assist clients in planning for and obtaining work authorizations, curricular
and optional practical training, changes and extensions of status, waivers of the two-year foreign residency requirement
for J visitors, and consular issues.
The Firm also work with clients in obtaining permanent resident status in all employment-based categories. We have
successfully obtained immigrant visas for individuals with extraordinary ability, outstanding researchers and professors,
multinational executives and managers, and individuals whose work is in the national interest. We also obtain approvals
of labor certification applications (both reduction in recruitment and traditional processing). In addition, the Firm
assists clients with adjustments of status, INS interviews and consular processing.
The Firm also provides assistance for employers to meet hiring requirements under the Immigration Reform and Control Act
of 1986, thereby avoiding fines, penalties and other employer sanctions. We train human resource personnel in I-9
compliance and proper recruiting and hiring methods, represent clients in I-9 audit situations, and conduct I-9 due
diligence for mergers and acquisitions. We also provide training and policies related to proper record keeping
requirements.
The Firm's Immigration group presents Immigration Law Seminars (at no charge to clients) to educate clients in
preventative liability practices and to provide clients with a better understanding of immigration procedures.
